1. Definitions
These definitions should help you understand this policy. When we say “we,” “us,” “our,” and “Marketing Engines,” we are referring to Marketing Engines, Inc d/b/a (Marketing Engine and Marketing Engines), a State of California Corporation company.
We provide multiple online platforms that you may use to market to or stay in contact with others, including branding, web design, various marketing channels and other information related to your Subscribers (the “Services”). When we say “Member,” we are referring to the person or entity that is registered with us to use the Services. When we say “you,” we are referring either to a Member or to some other person who visits any of our Websites. A “Subscriber” is a person you contact through our Services, or a person who you might choose to contact at some point in the future through the use of our Services. In other words, a Subscriber is anyone that is a prospective client of yours of whom you have given and/or shared their information with us. “Personal Information” means information that can be used to identify you or a Subscriber, including, but not limited to, first and last name, date of birth, phone, email address, gender, occupation or other demographic information.
Marketing Engines, Inc. (“Marketing Engines” or the “Company”) is committed to protecting the privacy of individuals who visit the Company’s Web sites (“Visitors”), individuals who register to use the Services as defined below (“Customers”), and individuals who register to attend the Company’s corporate events (“Attendees”). This Privacy Statement describes Marketing Engines privacy practices in relation to the use of the Company’s Web sites and the related applications and services offered by Marketing Engines (collectively, the “Services”).
When we collect personal information from you on our website, we follow the privacy principles of ICDR/AAA Privacy Shield Program, an independent resource mechanism and an alternative dispute resolution provider located in the United States.
The ICDR/AAA policy applies to information that is collected, handled, or maintained through the Web sites covered by this Privacy Statement.

(collectively referred to as “Marketing Engines Web sites” or “the Company’s Web sites”, each a “Website” and together the “Websites”). The “Websites” include the Websites themselves, and any web pages, interactive features, applications, widgets, blogs, social networks, social network “tabs,” or other online, mobile, or wireless offerings that post a link to this Privacy Policy, whether accessed via computer, mobile device, or other technology, manner or means. While providing the Services, and as described in more detail below, we may collect Personal Information about a Website visitor, Member, person or email address on or related to a Subscriber.
This Privacy Policy applies to all of these specific websites, all offered Services on any of these websites and as well as any other sites owned or operated by us.
Cylinder, https://cylinder.marketing, is a multi-channel online marketing application that runs on a different platform that Company’s Marketing Engines Web site. There are API Applications integrated with Marketing Engines Web sites and third parties. When applications are posted by Marketing Engines and the application links to this Privacy Statement, this Privacy Statement applies. When applications are posted by third parties, the privacy statement of the third party applies, and this Privacy Statement does not apply.
All Marketing Engines Web sites will link to this Privacy Statement, and this Privacy Statement applies. When Web sites are posted by third parties, the privacy statement of the third party applies, and this Privacy Statement does not apply.
Marketing Engines Web sites may contain links to other Web sites. The information practices or the content of such other Web sites is governed by the privacy statements of such other Web sites. The Company encourages you to review the privacy statements of other Web sites to understand their information practices.
3. Changes to this Privacy Statement
Marketing Engines reserves the right to change this Privacy Statement. Marketing Engines will provide notification of the material changes to this Privacy Statement through the Company’s Web sites at least thirty (30) business days prior to the change taking effect.
We may change this Privacy Policy at any time and from time to time. The most recent version of the Privacy Policy is reflected by the version date located within this Privacy Policy. All updates and amendments are effective immediately upon notice, which we may give by any means, including, but not limited to, by posting a revised version of this Privacy Policy or other notice on the Website. We encourage you to review this Privacy Policy often to stay informed of changes that may affect you, as your continued use of the Website signifies your continuing consent to be bound by this Privacy Policy. Our electronically or otherwise properly stored copies of this Privacy Policy are each deemed to be the true, complete, valid, authentic, and enforceable copy of the version of this Privacy Policy which were in effect on each respective date you visited the Website.

This Privacy Policy is effective with respect to any data that we have collected, or collect, about and/or from you, according to our Terms of Use.

Your Information
Marketing Engines respects the privacy of visitors to its websites, as a result, we have developed this website privacy policy. This website privacy policy applies only to the operation of websites that directly link to this policy when you click on “privacy statement” in the website footer. Through this website Marketing Engines will collect information that can identify you, such as your name, address, telephone number, e-mail address, and other similar information (“Your Information”) when it is voluntarily submitted to us (how-ever, see discussion below about “IP Addresses” if you have a broadband connection). We will use Your Information to respond to requests you may make of us, and from time to time, we may refer to Your Information
6. Information collected
When expressing an interest in obtaining additional information about the Services, or registering to use the Web sites or other Services, or registering for an event, Marketing Engines requires you to provide the Company with personal contact information, such as name, company name, address, phone number, and email address (“Required Contact Information”). When purchasing the Services or registering for an event, Marketing Engines may also require you to provide the Company with financial qualification and billing information, such as billing name and address, credit card number, bank information and the number of employees within the organization that will be using the Services (“Billing Information”). Marketing Engines may also ask you to provide additional information, such as company annual revenues, number of employees, or industry (“Optional Information”). When Visitors apply for a job with the Company, Marketing Engines may also require you to submit additional personal information as well as a resume or curriculum vitae (“Applicant Information”). Required Contact Information, Billing Information, Applicant Information, Optional Information and any other information you submit to Marketing Engines to or through the Services are referred to collectively as “Data.”
As you navigate the Company’s Web sites, Marketing Engines may also collect information through the use of commonly—used information—gathering tools, such as cookies and Web beacons (“Web Site Navigational Information”). Web Site Navigational Information includes standard information from your Web browser (such as browser type and browser language), your Internet Protocol (“IP”) address, and the actions you take on the Company’s Web sites (such as the Web pages viewed and the links clicked).
- When you request additional information or register on Marketing Engines Web site, the Company will ask you to provide basic contact information.
- When you purchase Marketing Engines applications or services (the “Services”), the Company will ask you to provide billing information.
- When you register for or attend corporate events, the Company will ask you to provide basic contact information, billing information, and information on your participation in the events on Marketing Engines Web sites.
- Marketing Engines uses common Internet technologies, such as cookies and Web beacons, to keep track of interactions with the Company’s Web sites and emails.
(a) Information you voluntarily provide to us: When you sign up for and use the Services, consult with our customer service team, send us an email, post on our blog, integrate the Services with another website or service (for example, when you choose to connect your e-commerce account with Marketing Engines), or communicate with us in any way, you are voluntarily giving us information that we collect. That information may include either your or your Subscriber’s name, physical address, email address, IP address, phone number, credit card information, as well as details including gender, occupation, location, purchase history, and other demographic information. By giving us this information, you consent to this information being collected, used, disclosed, transferred to the United States and stored by us, as described in Dominate Real Estate Terms of Use and in this Privacy Policy.
(b) Information we collect automatically: When you use the Services or browse one of our Websites, we may collect information about your visit to our Websites, your usage of the Services, and your web browsing. That information may include your IP address, your operating system, your browser ID, your browsing activity, and other information about how you interacted with our Websites or other websites. We may collect this information as a part of log files as well as through the use of cookies or other tracking technologies. Our use of cookies is discussed more below, and in more detail in Marketing Engines Cookie Statement.
(d) Information from your use of the Service: We may receive information about how and when you use the Services, store it in log files or other types of files associated with your account, and link it to other information we collect about you. This information may include, for example, your IP address, time, date, browser used, and actions you have taken within the application. This type of information helps us to improve our Services for both you and for all of our users.
(e) Cookies and tracking: We and our partners use cookies or similar technologies to analyze trends, administer the website, track users’ movements around the website, and to gather demographic information about our user base as a whole. Users can control the use of cookies at the individual browser level. We partner with a third party to either display advertising on our website or to manage our advertising on other sites. Our third party partner may use cookies or similar technologies in order to provide you advertising or other content based upon your browsing activities and interests. If you wish to opt out of interest-based advertising click http://go.adr.org/privacyshield.html (or if located in the European Union click http://www.youronlinechoices.eu/). Please note you might continue to receive generic ads. (f) Web beacons: We use web beacons on our Websites and in our emails. When we send emails to Members, we may track behavior such as who opened the emails and who clicked the links. This allows us to measure the performance of our email campaigns and to improve our features for specific segments of Members. To do this, we include single pixel gifs, also called web beacons, in emails we send. Web beacons allow us to collect information about when you open the email, your IP address, your browser or email client type, and other similar details. We also include Web Beacons in the emails we deliver for you. We use the data from those Web Beacons to create reports about how your email campaign performed and what actions your Subscribers took. Reports are also available to us when we send email to you, so we may collect and review that information.
(g) Information from other sources: We may receive more information about you or your Subscribers, such as name, email address, demographic information, IP addresses, location, and use of social media websites, by searching the Internet or querying third parties (we refer to that information as “Supplemental Information”). We use Supplemental Information to develop features including Social Profiles, a tool that helps you learn about your Subscribers and allows you to send them more relevant content.
(h) Information from the use of our Mobile Apps: When you use our mobile apps, we may collect certain information in addition to information described elsewhere in this Policy. For example, we may collect information about the type of device and operating system you use. We may ask you if you want to receive push notifications about activity in your account. If you have opted in to these notifications and no longer want to receive them, you may turn them off through your operating system. We do not access or track any location-based information from your mobile device unless you have given us permission. We may use mobile analytics software (such as Fabric.io) to better understand how people use our application. We may collect information about how often you use the application and other performance data.
7. Use of information collected
- Marketing Engines uses Data about Marketing Engines Customers to perform the services requested. For example, if you fill out a “Contact Me” Web form, Marketing Engines will use the information provided to contact you about your interest in the Services.
- Marketing Engines also uses Data about Marketing Engines Attendees to plan and host corporate events, host online forums and social networks in which event attendees may participate, and to populate online profiles for Attendees on the Company’s Web sites. Additional information on the Company’s privacy practices with respect to Data about Marketing Engines Attendees may be found in additional privacy statements on the event Web sites, as the case may be.
- Marketing Engines may also use Data about Marketing Engines Customers and Data about Marketing Engines Attendees for marketing purposes. For example, the Company may use information you provide to contact you to further discuss your interest in the Services and to send you information regarding the Company, its affiliates, and its partners, such as information about promotions or events.
- Marketing Engines uses credit card information solely to check the financial qualifications and collect payment from prospective Customers and Attendees.
- Marketing Engines uses Web Site Navigational Information to operate and improve the Company’s Web sites. The Company may also use Web Site Navigational Information alone or in combination with Data about Marketing Engines Customers and Data about Marketing Engines Attendees to provide personalized information about the Company.
- Marketing Engines uses information collected to provide you with the services you request.
- Marketing Engines may use information collected to provide you with additional information about the Company’s Services, partners, promotions, and events.
- Marketing Engines may use information collected to improve the Company’s Web sites and Services.
- Unless described in the full Privacy Statement, Marketing Engines does not share, sell, rent, or trade personally identifiable information with third parties for their promotional purposes. Marketing Engines may share information collected with other companies that work on Marketing Engines behalf.
8. Public Information and Third Party Websites
(a) Blog: We have public blogs on our Websites. Any information you include in a comment on our blog may be read, collected, and used by anyone. If your Personal Information appears on our blogs and you want it removed, please contact Marketing Engines. If we are unable to remove your information, we will tell you why.
(b) Social media platforms and widgets: Our Websites include social media features, such as the Facebook Like button. These features may collect information about your IP address and which page you are visiting on our Website, and they may set a cookie to make sure the feature functions properly. Social media features and widgets are either hosted by a third party or hosted directly on our Website. We also maintain presences on social media platforms including Facebook, LinkedIn, Twitter, Instagram and many others. Any information, communications, or materials you submit to us via a social media platform is done at your own risk without any expectation of privacy. We cannot control the actions of other users of these platforms or the actions of the platforms themselves. Your interactions with those features and platforms are governed by the privacy policies of the companies that provide them.
(c) Links to third-party websites: Our Websites include links to other websites, whose privacy practices may be different from Marketing Engines. If you submit Personal Information to any of those sites, your information is governed by their privacy policies. We encourage you to carefully read the privacy policy of any Website you visit.
9. Third Parties
We may disclose Personal Information to the following types of third parties for the purposes described in this policy:
(a) Service providers: Sometimes, we need to use third party Service Providers in order to provide and support the features of our Services. For example, if it is necessary to provide you something you have requested (like send you a T-shirt or enable a feature such as Social Profiles), then we may share your Personal Information with a Service Provider for that purpose. We will tell you we are working with a Service Provider whenever reasonably possible, and you may request at any time the names of our Service Providers. Just like with the other third parties we work with, these third party Service Providers enter into a contract that requires them to use your Personal Information in a manner that is consistent with this policy.
(b) Advertising partners: We may partner with third parties to display advertising on our Websites or to manage our advertising on other sites and may share Personal Information with them for this purpose. All third parties with which we share this information enter into a contract with us that requires them to use your Personal Information in a manner that is consistent with this policy. We or our third party partners may use technologies, such as cookies, to gather information about your activities on our Websites and other sites in order to provide you with advertising based on your browsing activities and interests. 10. Promotions, Contest and Sweepstakes
We may, from time to time, offer surveys, contests, sweepstakes, or other promotions on our Websites or through social media (collectively “Our Promotions”). Participation in our Promotions is completely voluntary. Information requested for entry may include personal contact information such as your name, address, date of birth, phone number, email address, username, and similar details. We use the information you provide to administer Our Promotions. We may also, unless prohibited by the Promotion’s rules or law, use the information provided to communicate with you, or other people you select, about our Services. We may share this information with our affiliates and other organizations or Service Providers in line with this policy and the rules posted for the Promotion.
11. Mobile applications
Without limiting the generality of this Privacy Statement, in addition to information gathered through its Web sites or submitted to its Services, Marketing Engines may obtain information through applications (“Mobile Applications”) that Customers or their authorized individuals (“Users”) download to, and run on, their mobile devices (“Devices”). Mobile Applications provided by Marketing Engines may obtain information from, or access data stored on, Users’ Devices to provide services related to the relevant Mobile Application. For example, a Mobile Application may: access a camera on a User’s Device to enable the User to upload photographs to the Services; access the call history on a User’s Device to enable the User to upload that information to the Services; access calendar information on a User’s Device to enable the User to match meeting attendees with contacts submitted by the User to the Services; access the geographic location of a User’s Device to enable the User to identify contacts submitted by the User the Services who are nearby; or access contact information on a User’s Device to enable the User to sync contact information between the information that is stored on the User’s Device and the information that is submitted to the Services. Information obtained to provide Mobile Application services may include information obtained in preparation for anticipated updates to those services. Mobile Applications may transmit information to and from Devices to provide the Mobile Application services.
Mobile Applications may provide Marketing Engines with information related to Users’ use of the Mobile Application services, information regarding Users’ computer systems, and information regarding Users’ interaction with Mobile Applications, which Marketing Engines may use to provide and improve the Mobile Application services. For example, all actions taken in a Mobile Application may be logged, along with associated information (such as the time of day when each action was taken). Marketing Engines may also share anonymous data about these actions with third party providers of analytics services. In addition, if a User downloads a Marketing Engines Mobile Application after clicking on a third-party mobile advertisement for the Mobile Application or for Marketing Engines, the third-party advertiser may provide Marketing Engines with certain information, such as the User’s Device identification information, which Marketing Engines may use to track the performance of its advertising campaigns.
Customers may configure Marketing Engines Mobile Application services, and the information accessed or obtained by the Mobile Application on a User’s Device may be affected by the Customer’s configuration. In addition, if a Customer purchases more than one Service from Marketing Engines and its affiliates, a Mobile Application may be designed to interoperate with those Services; for instance, to provide a User with access to information from any or all of those Services or to provide information from a User’s Device to any or all of those Services. Information accessed or obtained by the Mobile Application on a User’s Device may be accessible to the Customer and its organization, depending on the intended functionality of the Mobile Application.
In addition to Mobile Applications offered by Marketing Engines, the Company may offer platforms for the creation of third-party Mobile Applications, including but not limited to the Marketing Engines1 platform. Third parties may obtain information from, or access data stored on, Users’ Devices to provide services associated with any third-party Mobile Applications that Users download, install, use, or otherwise interact with over a Marketing Engines platform. Marketing Engines Mobile Applications may also contain links or integrations to other Mobile Applications provided by third parties. Third parties’ use of information collected through third-party Mobile Applications is governed by the privacy statements of such third parties. The Company encourages you to review the privacy statements of third-party providers of Mobile Applications to understand their information practices.
Notices and contractual terms related to a particular Mobile Application may be found in the End User License Agreement or relevant terms of service for that application. The Company encourages you to review the End User License Agreement or relevant terms of service related to any Mobile Applications you download, install, use, or otherwise interact with to understand that Mobile Application’s information practices. The Mobile Application’s access to information through a User’s Device does not cause that information to be “Customer Data” under Marketing Engines Master Service Agreement with the Customer or under this Privacy Statement, except as follows: To the extent that a User uses a Mobile Application to submit electronic data and information to a Customer account on our Services pursuant to the Customer’s Master Service Agreement with Marketing Engines (or a similar agreement that governs the Customer’s subscription(s) to Marketing Engines Services), that information constitutes “Customer Data” as defined in such agreement, and the provisions of that agreement with respect to privacy and security of such data will apply. Additional information about the Company’s privacy and security practices with respect to Customer Data is available on Marketing Engines Agreements and Forms page.
12. Public forums, refer a friend, and customer testimonials
Marketing Engines may provide bulletin boards, blogs, or chat rooms on the Company’s Web sites. Any personal information you choose to submit in such a forum may be read, collected, or used by others who visit these forums, and may be used to send you unsolicited messages. Marketing Engines is not responsible for the personal information you choose to submit in these forums.
Customers and Visitors may elect to use the Company’s referral program to inform friends about the Company’s Web sites. When using the referral program, the Company requests the friend’s name and email address. Marketing Engines will automatically send the friend a one–time email inviting him or her to visit the Company’s Web sites. Marketing Engines does not store this information.
Marketing Engines posts a list of Customers and testimonials on the Company’s Web sites that contain information such as Customer names and titles. Marketing Engines obtains the consent of each Customer prior to posting any information on such a list or posting testimonials.
13. Sharing of information collected
Service Providers
Marketing Engines may share Data about Marketing Engines Visitors, Customers and Attendees with the Company’s contracted service providers so that these service providers can provide services on our behalf. Without limiting the foregoing, Marketing Engines may also share Data about Marketing Engines Visitors, Customers and Attendees with the Company’s service providers to ensure the quality of information provided, and with third–party social networking and media Web sites, such as Facebook, for marketing and advertising on those Web sites. Unless described in this Privacy Statement, Marketing Engines does not share, sell, rent, or trade any information with third parties for their promotional purposes.
Marketing Engines Affiliates
The Company may share Data about Marketing Engines Customers with other companies in order to work with them, including affiliates of the Marketing Engines corporate group. For example, the Company may need to share Data about Marketing Engines Customers for customer relationship management purposes.
Business Partners
From time to time, Marketing Engines may partner with other companies to jointly offer products or services, such as our Cylinder partners. If you purchase or specifically express interest in a jointly–offered product or service from or through Marketing Engines, the Company may share Data about Marketing Engines Customers collected in connection with your purchase or expression of interest with our partner(s). Marketing Engines does not control our business partners’ use of the Data about Marketing Engines Customers we collect, and their use of the information will be in accordance with their own privacy policies. If you do not wish for your information to be shared in this manner, you may opt not to purchase or specifically express interest in a jointly offered product or service.
Marketing Engines does not share Data about Marketing Engines Attendees with business partners unless: (1) you specifically opt in to such sharing via an event registration form; or (2) you attend a Company event and allow Marketing Engines or any of its designees to scan your attendee badge. If you do not wish for your information to be shared in this manner, you may choose not to opt in via event registration forms and elect not to have your badge scanned at Company events. If you choose to share your information with business partners in the manners described above, your information will be subject to the business partners’ respective privacy statements.
Third Parties
Section 4 of this Privacy Statement, Web Site Navigational Information, specifically addresses the information we or third parties collect through cookies and web beacons, and how you can control cookies through your Web browsers.
Billing
Marketing Engines uses a third—party service provider to manage credit card processing. This service provider is not permitted to store, retain, or use Billing Information except for the sole purpose of credit card processing on the Company’s behalf.
Compelled Disclosure
Marketing Engines reserves the right to use or disclose information provided if required by law or if the Company reasonably believes that use or disclosure is necessary to protect the Company’s rights and/or to comply with a judicial proceeding, court order, or legal process.
14. International transfer of information collected
The Company primarily stores Data about Marketing Engines Customers and Data about Marketing Engines Attendees in the United States. To facilitate Marketing Engines global operations, the Company may transfer and access such information from around the world, including from other countries in which the Company has operations. A list of the Company’s global offices is available here. This Privacy Statement shall apply even if Marketing Engines transfers Data about Marketing Engines Customers or Data about Marketing Engines Attendees to other countries.
15. Communications preferences
Marketing Engines offers Visitors, Customers, and Partners and Attendees who provide contact information a means to choose how the Company uses the information provided. You may manage your receipt of marketing and non-transactional communications by clicking on the “unsubscribe” link located on the bottom of the Company’s marketing emails. Additionally, you may unsubscribe from all Marketing Engines communications.
Every marketing email from Marketing Engines contains instructions on how to opt out of receiving further marketing emails from the Company. If you provide Marketing Engines with contact information, you can manage how the Company uses your information by accessing our Preference Center.
16. Correcting and updating your information
Customers may update or change their registration information by editing their user or organization record. To update a user profile, please login to https://marketingengines.com with your username and password and click “Profile.” To update an organization’s information, please login to https://marketingengines.io with your username and password and select “Organization Setup.” Attendees may update or change their registration information on the event’s Web site after logging in. To update Billing Information or have your registration information deleted, please contact Marketing Engines. To discontinue your account and to have information you maintained in the Services returned to you, please contact Marketing Engines. Requests to access, change, or delete your information will be handled within 30 days.
17. Customer Data
Marketing Engines Customers may electronically submit data or information to the Company’s services (“Customer Data”). Marketing Engines will not review, share, distribute, or reference any such Customer Data except as provided in Marketing Engines Master Service Agreement, or as may be required by law. In accordance with Marketing Engines Service Agreement, Marketing Engines may access Customer Data only for the purpose of providing the Services or preventing or addressing service or technical problems, at a Customer’s request in connection with customer support matters, or as may be required by law.
18. Data Collected for and by our Users
As you use Marketing Engines Services, you may import into our system Personal Information you have collected from your Contacts, Customers or other individuals (“Subscribers”). We have no direct relationship with your Subscribers or any person other than you, and for that reason, you are responsible for making sure you have the appropriate permission for us to collect and process information about those individuals. Consistent with the uses of Personal Information covered in this policy, we may transfer Personal Information of you or your Subscribers to companies that help us promote, provide, or support our Services or the services of our Members (“Service Providers”). All Service Providers enter into a contract with us that protects Personal Information and restricts their use of any Personal Information consistent with this policy. As part of our Services, we may use and incorporate into features information you have provided, we have collected from you, or we have collected about Subscribers. We may share this information, including Subscriber email addresses, with third parties in line with the approved uses in this policy.
If you are a Subscriber and no longer want to be contacted by one of our Members, please unsubscribe directly from that Member’s newsletter or contact the Member directly to update or delete your data. If you contact us, we may remove or update your information within a reasonable time and after providing notice to the Member of your request.
We will retain Personal Information we process on behalf of our Members for as long as needed to provide our Services or to comply with our legal obligations, resolve disputes, prevent abuse, and enforce our agreements.
19. Use and Disclosure of Personal Information
We may use and disclose Personal Information only for the following purposes:
- To promote use of our services to you.
- To send you informational and promotional content that you may choose (or “opt in”) to receive.
